Please read these Terms & Conditions carefully before placing an order. By using our online ordering platform, you agree to be bound by these terms in accordance with applicable Canadian laws and regulations.
1. Acceptance of Terms
By accessing or using the Princess Kitchen online ordering service ("Service"), you agree to comply with and be bound by these Terms & Conditions ("Terms"), our Privacy Policy, and all applicable Canadian federal and provincial laws. If you do not agree to these Terms, please do not use our Service.
2. Online Ordering Service
Our Service allows you to browse our menu, place food orders, and arrange for pickup or delivery. By placing an order through our platform:
- You confirm that all information provided is accurate and complete.
- You understand that order acceptance is subject to our discretion and product availability.
- You acknowledge that pricing displayed is subject to applicable taxes (GST/PST/HST).
- You agree that orders cannot be cancelled once confirmed by the restaurant.
3. Pricing & Payment
All prices are displayed in Canadian dollars (CAD) and are subject to applicable taxes as required by law:
- GST (Goods and Services Tax): 5% federal tax applicable to most food items as per the Excise Tax Act (R.S.C., 1985, c. E-15).
- PST (Provincial Sales Tax): Applicable rates vary by province.
- Delivery fees, where applicable, are displayed prior to checkout.
- We accept payment via cash on delivery, credit card, and other indicated payment methods.
Prices are subject to change without notice. The price shown at the time of checkout is the price you will pay.
4. Delivery Policy
- Delivery is available within our designated delivery zones only.
- Estimated delivery times are provided as guidance only and may vary due to weather, traffic, or high demand.
- We are not liable for delays caused by circumstances beyond our control.
- Customers must ensure the delivery address is accurate. We are not responsible for failed deliveries due to incorrect information.
5. Food Allergies & Dietary Requirements
⚠️ Important: Our kitchen handles common allergens including nuts, gluten, dairy, eggs, shellfish, and soy. We cannot guarantee a completely allergen-free environment. If you have a severe food allergy, please contact us directly before ordering. We comply with Health Canada food labelling regulations for known allergens.
6. Privacy Policy & Personal Information (PIPEDA)
We collect and use your personal information in accordance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA, S.C. 2000, c. 5) and applicable provincial privacy legislation.
- Information Collected: Name, phone number, email address, delivery address, and order history.
- Purpose: To process orders, communicate about orders, and with your consent, send marketing communications.
- Retention: Personal information is retained for as long as necessary to fulfill the stated purposes or as required by law.
- Access & Correction: You have the right to access, correct, or request deletion of your personal information by contacting us.
- Third Parties: We do not sell your personal information. We may share it with service providers (payment processors, delivery partners) who are bound by confidentiality agreements.
- Data Security: We implement industry-standard security measures to protect your personal information.
7. Email Marketing & CASL Compliance
We comply with Canada's Anti-Spam Legislation (CASL, S.C. 2010, c. 23). Regarding commercial electronic messages (CEMs):
- We only send marketing emails to customers who have provided express or implied consent.
- Every marketing email includes a clear and functional unsubscribe mechanism.
- Unsubscribe requests are processed within 10 business days as required by CASL.
- You may withdraw consent at any time by clicking the unsubscribe link in any email or by contacting us directly.
- Transactional emails related to your orders are not subject to CASL opt-out provisions.

10. Limitation of Liability
To the maximum extent permitted by applicable Canadian law:
- We are not liable for any indirect, incidental, special, or consequential damages arising from your use of our Service.
- Our total liability for any claim shall not exceed the amount paid by you for the specific order giving rise to the claim.
- We are not liable for any losses resulting from events beyond our reasonable control (force majeure).
11. Dispute Resolution
In the event of a dispute:
- We encourage you to first contact us directly to resolve any issues.
- If unresolved, disputes shall be governed by the laws of the Province of Saskatchewan and the laws of Canada applicable therein.
- The courts of Saskatchewan shall have jurisdiction over any dispute arising from these Terms.
